The dunya-escapes.com website (hereinafter “the Site”) is published by Dunya Travel Escapes SRL (“Seller”), a Romanian legal entity, having its registered office at Bach Street, No. 16, Sector 2, Bucharest, registered in the Bucharest Trade Register under number J40/8299/2023 and VAT ID RO48101603, registered in the Register of Travel Agencies at the Bucharest Ministry of Tourism under license number 2837.

When browsing our website, terms such as, but not limited to, “we”, “us”, “our”, refer to Dunya Travel Escapes SRL. Our website includes all information and services available to users who accept the terms and conditions and other details set out in this document.

By visiting our website or ordering any service or product available from Dunya Travel Escapes SRL, you agree to be bound by these Terms and Conditions, including any additional terms, conditions and policies referenced below and/or accessible via hypertext links. These Terms and Conditions apply to all users of the website, including, but not limited to, users who are browsers, suppliers, customers, merchants and/or content distributors.

General terms and conditions

By accepting the terms and conditions presented on this page, you acknowledge that you are of legal age according to the laws of Romania and give your consent to the use of our Site by your minors. We reserve the right to refuse to provide services to any person, for any reason, at any time. If you have any problems related to an order that do not seem to be able to be resolved by e-mail or with the person you are communicating with, you can contact us at info@dunya-escapes.com.

Personal data processing

By providing your data when creating an account, filling in the registration form or contacting us by any means (contact form, e-mail, telephone, social networks, etc.), you understand that your personal data will be included in our database and processed on the basis of the electronic contract between the parties (general terms and conditions), in order to respond to your requests, provide requested technical assistance and improve our products and services. However, our company may also send you personalized offers if you have placed an order on our site at least once, based on our legitimate interest for marketing and advertising purposes (art. 6/1/f of the GDPR).

You are prohibited from using false e-mail addresses/social media accounts, pretending to be someone other than yourself or attempting to mislead Dunya Travel Escapes SRL as to the origin of any comments. You are directly responsible for any comments/opinions you post and for the accuracy of the information posted.

Dunya Travel Escapes SRL is not responsible and assumes no liability for any comments posted by you or any
third party.

We have ensured that our employees authorized to process personal data undertake to maintain the confidentiality of data in accordance with the provisions of the RGPD, throughout the duration of their employment and even after its termination.

Dunya Travel Escapes SRL takes all necessary security measures to protect the personal information of its customers and users of its Site. By creating an account on our Site, processing an order or using the contact form, the user assumes responsibility for the information transmitted. When personal data is transmitted to us via the “Contact” section, the information will be protected both offline and online. All user information is confidential. The servers on which users’ personally identifiable information is stored are located in a secure area.

Products and services

Offers made by Dunya Travel Escapes SRL via the Site may be booked online or by telephone. Dunya Travel Escapes SRL does not guarantee the availability of products/services at all times. We reserve the right, but are not obligated, to limit the provision of services/products to specific persons, geographic regions or locations. We may exercise this right on a case-by-case basis. We reserve the right to limit the availability of any service/product published on the site.

All service/product descriptions or prices displayed on the site are subject to change at any time without notice, at our discretion. Any offer for a service/product is void where prohibited, derisory or clearly erroneous. Dunya Travel Escapes SRL is not responsible for the quality of any service/product, information or material purchased or obtained by you through Dunya Travel Escapes SRL’s network of integrated partners.

Booking procedure

We invite you to visit the contact page from the Dunya website or via social networks to request a quote and register for a Dunya trip using the registration form.

If you are interested in a trip, we invite you to request a quote on our website in the dedicated section or to contact us by e-mail at the following address: info@dunya-escapes.com or send us a message on our Instagram page Dunya.escapes.

Registration

A booking is firm and definitive once the quotation and booking form (FI) have been completed and signed, and the deposit or total price of the trip (depending on the date of departure) has been paid in accordance with the procedure described in article 10. of these terms and conditions.

For the order to be definitively validated, the customer must accept the General Terms and Conditions by clicking where indicated on the registration form.

The customer must provide a valid e-mail address when placing the order, and acknowledges that any exchange with the Vendor may take place via this address. As the delivery of travel documents and all information relating to the Service is carried out by e-mail, the customer must consult his e-mail box regularly.

The customer must inform the Vendor, in writing and prior to any order, of any particularity concerning him/her that may affect the smooth running of the Event (persons with reduced mobility with or without a wheelchair, special diet, presence of an animal, etc.).

Payment conditions

For all bookings made more than 45 days before the departure date, Dunya Travel Escapes SRL will collect a deposit of 30% of the total price of the trip. The balance of the trip price must be paid, without any reminder from us, and must be collected by Dunya Travel Escapes SRL no later than 45 days before the departure date. Any delay in the payment of a deposit and/or the balance of the price will be considered as a cancellation on your part, for which the cancellation charges referred to in article 12.1 below will be applied. For all bookings made less than 45 days before the departure date: you must pay the full price of the trip.

Payment method

Payment for the travel service purchased can be made by bank transfer (SEPA or international transfer) or with Paypal (paypal.me/DunyaTravelEscapes).

Billing

For all payments validated and collected by Dunya Travel Escapes SRL, an invoice will be sent to the person signing the registration form within 15 days of collection.

Prices and surcharges

Our tours are subject to variable and seasonal pricing, which is standard practice in the travel industry. This means that our tour prices may vary at any time depending on demand, market conditions and availability.

Cancelation policy

— IN THE EVENT OF CANCELLATION BY YOU

If you cancel all or part of the services in your booking, the cancellation conditions defined in the service contract will apply. A cancellation will only be effective when we receive the written confirmation you have sent to your relevant sales representative.

If the Customer cancels the order before the start of the service and/or does not take part in the Service ordered, he/she will be liable to pay Dunya Travel Escapes SRL compensation for the steps taken and costs incurred in accordance with the scale below :

• — Cancellation more than 90 days before departure : no compensation, full refund of deposit.
• — Cancellation between 90 and 60 days before departure : 30% of the total cost of the trip.
• — Cancellation between 60 and 45 days before departure : 50% of the total cost of the trip.
• — Cancellation less than 45 days before departure or no-show : 100% of the total cost of the trip.

Any expenses incurred by the customer prior to cancellation, such as transport costs and travel insurance, will not give rise to any reimbursement or compensation.

— DUNYA CANCELS DUE TO LACK OF PARTICIPANTS

Exceptionally, we may be forced to cancel a departure if the minimum number of participants is not reached. You will be informed of this decision no later than 20 days before the start of the trip or holiday.
You may be offered an alternative solution.

If the proposed alternatives do not suit you, your payments will be refunded in full, without further compensation. All expenses incurred by you remain your responsibility (purchase of plane or train tickets, hotel, travel equipment, etc.).

— FORCE MAJEURE CANCELLATION

We will not be liable or compensate you if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these terms and conditions, force majeure means any event beyond our control or that of our supplier, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include war and acts of terrorism (and the threat thereof), civil unrest, significant risks to human health such as the outbreak of a serious illness at the travel destination or natural disasters such as floods, earthquakes or weather conditions which prevent safe travel to or remain at the travel destination, any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid.

Liability

Liability is limited to the price of the trip for which compensation is claimed. Exceptions may be defined for certain tours and will be specified in the service contract.
The claim must be submitted to Dunya Travel Escapes SRL in writing, by e-mail, no later than 4 weeks after the end of the trip; otherwise it will be lost.

Dunya Travel Escapes SRL is not liable if the non-performance or improper performance of the contract is due to: failure to act on the part of the customer; an unforeseeable and unavoidable omission on the part of a third party, who is not involved in the provision of the services agreed upon in the contract; force majeure or an event that Dunya Travel Escapes SRL or a service provider could not have foreseen or avoided, notwithstanding the due care required.

Dunya Travel Escapes SRL is therefore not responsible for itinerary changes caused by strikes, social unrest, weather conditions, decisions taken by the authorities, delays by third parties, etc., or schedule changes due to flight schedule changes.

Required informations

In order for us to confirm your travel arrangements, you must provide all requested details.
The details required vary by trip; they generally include, but are not limited to, full name as per passport, date of birth, nationality, passport number, passport issue date and expiry date and any pre-existing medical conditions you have that may affect your ability to complete your travel arrangements.
Travellers are responsible for obtaining all documents required for their participation in the trip, such as a valid passport, all visas, vaccination certificates, insurance and any other documents. Failure to obtain documents does not invalidate the terms and conditions, and any additional costs incurred for re-routing due to travel without the necessary documents will be the responsibility of the traveler and additional charges will apply.

When you fill out an application, reservation or other form on our website, certain information is required before you can submit the forms to us. When you submit information to us, including as part of a registration, request or reservation, you must ensure that it is true, accurate, current and complete in all respects, and you represent that it is. We rely on the information you have provided.

Insurance

Dunya Travel Escapes SRL strongly recommends that passengers take out appropriate travel, medical and cancellation insurance.

Settlement of disputes. Applicable law

Any attempt at unauthorized access to the site and any attempt at fraud will be reported to the appropriate authorities. Any dispute between Dunya Travel Escapes SRL and the customer will be attempted to be resolved amicably through mutual understanding between the two parties. We invite you to communicate any dissatisfaction you may have with our products and services to the following e-mail address info@dunya-escapes.com in order to quickly resolve the reported situation.

If the dispute cannot be resolved amicably, the provisions of Romanian law in the field concerned will apply, and the settlement of disputes will fall within the jurisdiction of the courts of law in Romania.
